<br />
After two police officers put a be-on-the-lookout bulletin on the radio for a vehicle that had been driving recklessly, a detective stopped the vehicle a short distance away in Loudoun. The detective removed defendant from the vehicle and patted him down for weapons. The detective felt a bulge in defendant's sock that he believed to be some type of weapon. The bulge was a glassine tube containing cocaine. The trial judge found that the officer stopped defendant based on a report of reckless driving and conducted the pat down for safety reasons. The appellate court held that there was no evidence that defendant had placed any officers in jeopardy. The detective did not articulate any facts or circumstances that gave rise to a safety concern. As a result, the trial judge erred in failing to suppress the evidence.<br />

The reckless driving statute, § 46.2-852, requires that the accused be driving on a highway, whereas the felony eluding statute, § 46.2-817(B), does not necessitate that the accused drive on a particular roadway. Section 46.2-852 provides that a violation may occur if the accused endangers any property of a person. Section 46.2-817(B), however, provides that a violation occurs only where the accused endangers the operation of a law enforcement vehicle, but not the law enforcement vehicle itself. It further requires that the accused receive a visible or audible signal from a police officer to stop his vehicle. Moreover, 46.2-817(B), unlike § 46.2-852, proscribes the driving of the accused only after he has disregarded an officer's signal to stop. Thus, felony eluding and reckless driving constitute separate offenses in that different facts are required to prove each.</li>

lower blood alcohol level is presumed not to be under the influence of
alcohol at the time of the offense. Once the Commonwealth introduces
evidence of a defendant's blood alcohol level in a trial for reckless
driving to establish that the defendant was driving recklessly, the
defendant's intoxication, i.e. whether he was operating a vehicle under
the influence of alcohol intoxicants, becomes an issue for the jury. In
that situation, the determination by the people's elected representatives
that a person with a blood alcohol level at or below 0.05 is presumed not
to be under the influence of alcohol is a relevant consideration for the

A police officer
saw defendant driving a jeep that was weaving and five times crossed the double
yellow line into the on-coming lane in Loudoun. The officer stopped the vehicle
and noticed signs of defendant's intoxication. Defendant pled guilty to driving
under the influence (DWI). At the trial on the habitual offender charge, the
Commonwealth introduced into evidence defendant's guilty plea and conviction on
the DWI charge, and a prior adjudication as an habitual offender. The trial
court denied defendant's motion to strike. Defendant was convicted. On appeal,
the court found that defendant's driving behavior clearly rose to the level of
reckless and could have endangered the life, limb, or property of another. The
trial judge correctly found that defendant's intoxication alone was not enough
to show that his driving of itself endangered the life, limb, or property of
another, and his intoxication when combined with the evidence of weaving was
sufficient to prove a violation of Va. Code Ann. § 46.2-357(B)(2). The court
also found that for § 46.2-357(B)(2) to apply, the driving behavior did not
have to actually harm another person or require another person to take evasive
action.<o:p></o:p></div>

improper driving, an offense set forth in Va. Code Ann. § 46.2-869, was a
lesser-included offense of reckless driving by speed. The appellate court
disagreed. Improper driving was not a lesser-included offense of reckless
driving by speed. Every commission of reckless driving by speed did not also
constitute improper driving. In addition, improper driving was not composed
entirely of the elements of reckless driving by speed. Improper driving
required an additional finding of slight culpability, an element excluded from
§ 46.2-862. The plain and unambiguous reading of § 46.2-869 made clear that
authority rested with the trial judge and not the jury to make the lesser degree
of culpability determination. In the alternative, an attorney for the
Commonwealth may have reduced a reckless driving charge to improper driving at
any time before the court's decision. Thus, only the trial judge, or the
prosecutor before the verdict was rendered, had the prerogative to reduce a
reckless driving charge to improper driving under § 46.2-869.<o:p></o:p></div>

Loudoun was
convicted of eluding a police officer and driving while intoxicated. Defendant
argued that his conviction for eluding a police officer constituted a
conviction for reckless driving, thereby requiring the trial court, in
obedience to Va. Code Ann. § 19.2-294.1, to have dismissed a driving while
intoxicated charge against him which arose out of the "same acts." On
appeal, the court affirmed the convictions. The court held that, because the
offense of eluding a police officer was not reckless driving on the date of the
offense, Va. Code Ann. § 19.2-294.1 did not pose a statutory bar to defendant's
conviction for driving while intoxicated in violation of Fairfax, Va., County
Code § 82-4-17. The court held that the 1984 amendment to Va. Code Ann. §
46.1-192.1 changed the offense of eluding a police officer so that it no longer
constituted the offense of reckless driving because it deleted the language
designating violations of the statute as reckless driving.<o:p></o:p></div>

property of another, language virtually identical to that found in the
statute defining reckless driving. Drunk driving does not per se deserve
felony treatment under § 46.2-357. While evidence of intoxication is a
factor that might bear upon proof of dangerous or reckless driving in a
given case, it does not, of itself, prove reckless driving. The essence of
the offense of reckless driving lies not in the act of operating a
vehicle, but in the manner and circumstances of its operation.<o:p></o:p></li>

Defendant argued
that the Loudoun court erred in denying her proposed jury instruction that
improper driving, an offense set forth in Va. Code Ann. § 46.2-869, was a
lesser-included offense of reckless driving by speed. The appellate court
disagreed. Improper driving was not a lesser-included offense of reckless
driving by speed. Every commission of reckless driving by speed did not also
constitute improper driving. In addition, improper driving was not composed
entirely of the elements of reckless driving by speed. Improper driving
required an additional finding of slight culpability, an element excluded from
§ 46.2-862. The plain and unambiguous reading of § 46.2-869 made clear that
authority rested with the trial judge and not the jury to make the lesser
degree of culpability determination. In the alternative, an attorney for the
Commonwealth may have reduced a reckless driving charge to improper driving at
any time before the court's decision. Thus, only the trial judge, or the
prosecutor before the verdict was rendered, had the prerogative to reduce a reckless
driving charge to improper driving under § 46.2-869.<o:p></o:p></div>

Code Ann. § 46.2-862, the Commonwealth must prove that the defendant was driving on a highway in the Commonwealth, and was driving (i) at a speed of twenty miles per hour or more in excess of the applicable maximum speed limit or (ii) in excess of eighty miles per hour regardless of the applicable maximum speed limit.<o:p></o:p></li>
